OSHA's Occupational Exposure to Crystalline Silica rule is deemed a major rule that will have a significant impact on the economy. For a 10-employee residential remodeling firm, the cost of the proposed rule would be approximately $35,000 or about $3,500 per employee. Costs vary by industry and firm size.OSHA completed its small business regulatory review panel Dec. 19, 2003 and its peer review Jan. 24, 2010. OSHA issued a new proposed rulemaking (NPRM) on Sept. 12, 2013. The agency held hearings on the proposed rule in March and April 2014. NARI has participated in this process through its membership in the Construction Industry Safety Coalition (CISC). Most recently, post hearing information was submitted by CISC on June 3, 2014. Final post hearing briefs are due by August 18, 2014.

NARI, along with the CISC, submitted comments to OSHA, urging the agency to withdraw the rule. In addition, the CISC testified before OSHA on March 24, 2014 and has continued to supply OSHA with information both before the hearing and in post hearing documents. It is expected that OSHA will finalize a silica rule by July 2015.

It is essential that as many NARI members as possible weigh in with their elected officials NOW before the rule is complete. As currently proposed, this Silica rule has the potential to be more far reaching, and more costly, than the residential lead paint rule.
